Terms of Service

These Terms of Service ("Terms") govern your use of the Workhorse platform at wrkhrs.co and the services connected to it (the "Service"), operated by Workhorse Collective, LLC ("Workhorse," "we," "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
If you use the Service on behalf of an organization, you agree to these Terms for that organization, and you confirm you have the authority to do so.
The Service
Workhorse is a brand and content platform. It helps you design systems, build sites, manage brand records, and create and publish work, with AI assistance throughout. We may add, change, or remove features over time. We aim to keep the Service available, but we do not guarantee it will be uninterrupted or error-free.
Your account
You must provide accurate information and keep it current. You are responsible for your account and for the activity under it, including the actions of people you invite to your workspace. Keep your credentials secure and tell us promptly if you suspect unauthorized use. You must be at least 13 years old to use the Service.
Acceptable use
You agree not to:
- Break the law or infringe anyone's rights.
- Upload or publish content you do not have the rights to use.
- Send spam, or send email to people who have not agreed to hear from you.
- Probe, attack, overload, or attempt to gain unauthorized access to the Service or its systems.
- Misuse AI features to generate unlawful, harmful, or deceptive content.
- Resell or provide the Service to others except as the Service intends.
We may suspend or remove content or accounts that violate these Terms.
Your content
You keep ownership of the content you create or upload ("Your Content"). You grant Workhorse the license needed to host, process, display, and transmit Your Content to operate the Service for you, including sending it to the AI providers and connected services required to perform the tasks you request.
You are responsible for Your Content and for having the rights to use it, including any client material, brand assets, contact lists, and audience data you bring to the platform. You confirm you have the consent or legal basis required to upload and process that data.
AI features
The Service uses AI to generate text, images, and other output. AI output can be inaccurate, incomplete, or unsuitable. Review it before you rely on or publish it. You are responsible for what you do with AI output. When you supply your own AI provider key, your use is also subject to that provider's terms. See our Privacy Policy for how content is processed.
Connected services
You can connect third party services such as Google, Meta, GitHub, payment processing, and others. Your use of those services is subject to their own terms, and we are not responsible for them. You authorize Workhorse to access and act on those accounts only as needed to provide the features you use. Use of Google APIs is also subject to the Google API Services User Data Policy. You can disconnect any service at any time.
Payments
Where the Service offers paid features, you agree to pay the stated fees. Payments are processed by Stripe, and you agree to its terms for payment processing. Fees are exclusive of taxes unless stated, and you are responsible for applicable taxes. Unless stated otherwise, fees are non-refundable.
If your workspace uses the Service to accept payments from your own customers, you are responsible for your obligations to those customers, including fulfillment, refunds, and disclosures.
Our intellectual property
The Service, including its software, design, and brand, belongs to Workhorse Collective, LLC and its licensors. These Terms do not transfer any ownership of the Service to you. You may not copy, modify, or reverse engineer the Service except as the law allows.
Termination
You can stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms or if we need to for legal or security reasons. On termination, your right to use the Service ends. Sections that by their nature should survive, such as ownership, disclaimers, and limitation of liability, will survive.
Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your requirements or be uninterrupted, secure, or error-free.
Limitation of liability
To the fullest extent permitted by law, Workhorse Collective, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim, or one hundred US dollars, whichever is greater.
Indemnification
You agree to defend and indemnify Workhorse Collective, LLC against claims, damages, and costs arising from Your Content or from your misuse of the Service or violation of these Terms.
Changes to these Terms
We may update these Terms as the Service changes. When we do, we will revise the date at the top. Material changes will be communicated through the Service. Continued use after a change means you accept the updated Terms.
Governing law
These Terms are governed by the laws of the District of Columbia and the applicable laws of the United States, without regard to conflict-of-laws rules. The state and federal courts located in the District of Columbia will have exclusive jurisdiction over disputes relating to these Terms.
